Continuances Procedure
All requests for continuances must be in writing and filed with the court or emailed at least seventy-two (72) hours before your hearing.
- When a continuance is sought for the reason that counsel is scheduled to appear in another case assigned for hearing on the same date in another Court, the movant shall attach a copy of the notice received from the other Court.
- No continuances in a civil case will be considered if filed within seventy-two (72) hours of the hearing date, unless the moving party secures consent of the other party in writing and such consent is filed with the Court.
- No continuance in a criminal or traffic case will be considered if filed within seventy-two (72) hours of the hearing date.
- A continuance that has NOT been ruled on by the date of the hearing shall be considered to be denied.
A continuance request form can be obtained from our website.
The request must include the case number, defendant’s name, as well as a good daytime telephone number.
Keep in mind that requesting to have a case continued does not guarantee that it will be granted. If the request is not granted and you fail to appear for a court ordered hearing, a warrant may be issued for your arrest.
